1. Agreement to these terms
By accessing or using Castaway AI at castawayai.com ("the Service"), operated by Snowy Mountain Software (ZYEYZ, LLC) ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of the Service
Castaway AI is a daily castaway survival serial written by an artificial-intelligence model and published with full disclosure that it is machine-generated. Reading is free and requires no account. You may optionally subscribe to an email newsletter.
3. AI-generated content
The narrative and the accompanying illustrations are generated by AI models, not written or drawn by a human author. The story is a work of fiction. It is not journalism, and nothing in it should be relied upon as factual, professional, medical, legal, financial, or safety advice. AI- generated content can contain errors, inaccuracies, or unexpected material; we review entries editorially before publication but do not warrant that the content is accurate or free of such material.
4. Accounts
Some features may require a free account. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide an accurate email address, to be at least 13 years old (or the age of digital consent in your jurisdiction), and not to share or transfer your account. We may suspend or terminate accounts that violate these terms.
5. Newsletter
The email newsletter is optional and double opt-in: you must confirm your subscription before we send anything, and every email includes a one-click unsubscribe link. See our Privacy policy for how we handle your email address.
6. Memberships and billing
We may offer paid memberships that provide additional features or support the project. If you purchase a membership, it is billed through Stripe on a recurring basis and renews automatically until canceled. You may cancel at any time from your account, and cancellation takes effect at the end of the current billing period. If you are unsatisfied, contact us within 7 days of a charge and we will consider a refund; renewal charges are handled on a case-by-case basis. Paid features are not required to read the story.
7. Acceptable use
You agree not to:
- Use the Service for any unlawful purpose;
- Attempt to gain unauthorized access to the Service or its systems;
- Interfere with or disrupt the Service's operation;
- Scrape, copy, republish, or redistribute the story or its imagery without our authorization;
- Create accounts by automated means;
- Share or transfer account credentials.
8. Intellectual property
The Service and its content, including the serial's text and illustrations, the site design, and all related materials, are owned by Snowy Mountain Software (ZYEYZ, LLC) and protected by applicable intellectual-property laws. You may read and share links to entries for personal, non-commercial use, but you may not redistribute, resell, or republish the story or images without our written permission.
9. Privacy
Our Privacy policy explains what we collect and why. By using the Service you also agree to that policy.
10. Disclaimer of warranties
The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or free of harmful components, or that the AI- generated content will meet any particular standard.
11. Limitation of liability
To the maximum extent permitted by law, Snowy Mountain Software (ZYEYZ, LLC) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
12. Changes to these terms
We may update these terms from time to time. We will update the "last updated" date above and, for significant changes, notify registered users via email or through the Service. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
13. Governing law
These terms are governed by the laws of the State of Montana, United States, without regard to its conflict-of-law principles.
